This Privacy Policy (“Policy”) describes how Linse Capital LLC and Linse Capital Management PR LLC (“Linse Capital,” “we,” “our,” “us”) collects, uses, and discloses certain personal information obtained through our website (“Site”), which is located at linsecapital.com, as well as other potentially linked services (collectively with the Site, the “Services”). By using our Services, you are agreeing to the terms of this Policy.

What Information We Collect and Maintain About You

We collect personal and other information from you directly when you provide it to us through the website. We also automatically collect certain information about you and your computer, smartphone, or other device when you use, access, or interact with our Site. We may also collect information from third parties in relation to providing you our Services.

Other personal information collected through the Site

You can visit the Site without submitting any information that we can use to identify you personally. However, to use certain features on the Site, such as the “Contact Us” feature, you will be required to provide personal information. Such information could include, for example, your name and email address.

Web log data. When you use the Site, we automatically receive and record certain information from your computer (or other device) and your browser. This may include such data as your IP address and domain name, the pages you visit on the Site, the date and time of your visit, the files that you download, the URLs from the websites you visit before and after navigating to the Site, your software and hardware attributes (including device IDs), your general geographic location (e.g., your city, state, or metropolitan region), and certain cookie information (see below). To obtain such information, we may use web logs or applications that recognize your computer and gather information about its online activity. Most of the information we collect through our Website is metadata. Metadata may include how and when a device or network is being used, login times and attempts, registry keys, types and versions of operating systems, browsers, and information about software applications. In some cases, we collect personal information as it may appear within the metadata such as that associated with usernames, filenames, file paths, and machine names. This personal information is used to help our customers and improve our capabilities in the way described in our more specific product or service documentation and agreements. Our Website also include features providing customers the ability to submit files (including the content of those files) and other information related to the files for purposes including security analysis and response, product improvement, enhanced capabilities, or customer support. At the direction of customers, we may also collect or retrieve files as part of our Website. An important type of data we detect, collect, analyze, and use through our Website (or provide our customers the ability to provide to us) is information about adversaries, for example, malware and URLs where adversaries try to send your data. We often discover this type of information from analyzing samples customers provide to us or from the data we collect from customers through our Website. To the extent we collects personal information through its Website, we generally collect that information under the authority and direction of its customers.

Cookies

We use cookies, local storage (HTML5), scripts and similar technologies to all our Websites to function properly, to help us continuously improve our Websites, and to customize a user's experience on our Websites. Cookies are small files that are stored on your computer by your web browser. A cookie allows the Site to recognize whether you have visited before and may store user preferences and other information. For example, cookies can be used to collect or store information about your use of the Site during your current session and over time (including the pages you view and the files you download), your computer’s operating system and browser type, your Internet service provider, your domain name and IP address, your general geographic location, the website that you visited before visiting the Site, and the link you used to leave the Site. If you are concerned about having cookies on your computer, you can set your browser to refuse all cookies or to indicate when a cookie is being set, allowing you to decide whether to accept it. You can also delete cookies from your computer. However, if you choose to block or delete cookies, certain features of the Site may not operate correctly.

Web beacons

The Site or the emails that you receive from Linse Capital may use an application known as a “web beacon” (also known as a “clear gif” or “web bug”). A web beacon is an electronic file that usually consists of a single-pixel image. It can be embedded in a web page or in an email to transmit information, which could include personal information. For example, it can allow an email sender to determine whether a user has opened a particular email.

Third-party online tracking and behavioral advertising.

We may partner with certain third parties to collect, analyze, and use the personal and other information described in this section. For example, we may allow third parties to set cookies or use web beacons on the Site or in email communications from us. This information may be used for a variety of purposes, including online interest-based advertising, as discussed below (see “With Whom and Why We Share Your Information”).

How We Use and Process Your Information

We use the information that we collect (described in “What Information We Collect and Maintain About You,” above) for a variety of purposes. Our legal bases for processing your personal information are: 1) our legitimate interest in running and maintaining our business; 2) performance and fulfillment of our contracts; 3) your consent; and 4) compliance with our legal obligations. In many instances, more than one of these legal bases apply to the processing of your personal information.

The purposes for which we use your information include to:

  • Provide you with our Services;
  • Respond to your questions or requests concerning the Services;
  • Fulfill the terms of any agreement you have with us;
  • Fulfill your requests for our Services or otherwise complete a transaction that you initiate;
  • Send you information about our Services and other topics that are likely to be of interest to you, including newsletters, updates, or other communications, including promotional emails;
  • Deliver confirmations, account information, notifications, and similar operational communications;Improve your user experience and the quality of our products and Services;
  • Comply with legal and/or regulatory requirements;
  • Aggregate and deidentify information;
  • Benchmark results for our customers;
  • Serve advertisements;
  • Analyze how visitors use the Services and various Services features, including to count and recognize visitors to the Services;
  • Manage our business.

We may link information gathered through the Site with information that we collect in other contexts. But in that event, we will handle the combined information in a manner consistent with this Policy.

With Whom and Why We Share Your Information

We may share any of the information described in “What Information We Collect and Maintain About You,” above, with other parties for a variety of purposes, as described below.

Third-party service providers

Linse Capital uses third-party service providers that perform services on our behalf, including web-hosting companies, mailing vendors, and analytics providers. These service providers may collect and/or use your information, including information that identifies you personally, to assist us in achieving the purposes discussed above.

We may share your information with other third parties when necessary to fulfill your requests for services; to complete a transaction that you initiate; to meet the terms of any agreement that you have with us or our partners; or to manage our business.

Analytics

We partner with certain third parties to obtain the automatically collected information discussed above and to engage in analysis, auditing, research, and reporting. These third parties may use web logs or web beacons, and they may set and access cookies on your computer or other device.

Interest-based advertising

The Site also enables third-party tracking mechanisms to collect information about you and your computing devices for use in online interest-based advertising. For example, third parties may use the fact that you visited our Site to target online ads to you. In addition, our third-party advertising networks might use information about your use of our Site to help target advertisements based on your online activity in general. For information about interest-based advertising practices, including privacy and confidentiality, visit the Network Advertising Initiative website or the Digital Advertising Alliance website.

The use of online tracking mechanisms by third parties is subject to those third parties’ privacy policies, and not this Policy. If you prefer to prevent third parties from setting and accessing cookies on your computer or other device, you may set your browser to block cookies.Additionally, you may remove yourself from the targeted advertising of companies within the Network Advertising Initiative by opting out, or of companies participating in the Digital Advertising Alliance by opting out. Our Site does not currently respond to “do not track” browser headers. However, you can adjust your browser settings to disable cookies if you have privacy concerns.

Legal purposes

We may use or share your information with third parties when we believe, in our sole discretion, that doing so is necessary:

  • To comply with applicable law or a court order, subpoena, or other legal process;
  • To investigate, prevent, or take action regarding illegal activities, suspected fraud, violations of our terms and conditions, or situations involving threats to our property or the property or physical safety of any person or third party;
  • To establish, protect, or exercise our legal rights or defend against legal claims; or to facilitate the financing, securitization, insuring, sale, assignment, bankruptcy, or other disposal of all or part of our business or assets.

Aggregated and de-identified information

From time to time, Linse Capital may share aggregated or de-identified information about users, such as by publishing a report on trends in the usage of the Site. Such aggregated information will not identify you personally.

Your Privacy Rights

If you are a resident of a jurisdiction with an applicable data privacy law, you may have certain rights available to you in relation to your personal information. These rights may include:

  • The right to access your personal information (including a data portability request);
  • The right to correct or amend any personal information we have on file about you;
  • The right to delete your personal information;
  • The right to limit the use of your “sensitive” personal information;
  • The right to opt-out of the sale or “sharing” of your personal information;
  • The right to opt-out of the use of your personal information for targeted advertising purposes;
  • The right to restrict or object to the processing of your personal information (such as for direct marketing purposes);
  • The right to restrict or opt-out of the use of your personal information for certain automated decision-making (including profiling in furtherance of decisions that produce legal or similarly significant effects);
  • The right to revoke your consent (to the extent applicable);
  • The right to confirm whether personal information about you is being processed;
  • The right to obtain a list of specific third parties (or categories of third parties) to which we have disclosed your personal information or any personal information.

We will respond to your request as soon as reasonably possible and within the timeframe required under applicable law, which is typically within 45 days of receipt. We will allow you to appeal any decision we make in response to such request in accordance with applicable law. Appeals may be submitted to finance@linsecapital.com with the subject line “Appeal of Decision Related to Privacy Rights Request.”

Prior to complying with your request, we will first verify your identity by comparing the information you provide with the information we have on file for you.

You may authorize an agent to make a request on your behalf. To designate an agent, please provide a written and signed document by both you and the agent that authorizes the agent to act on your behalf. You may also use a power of attorney. We will still require you to provide information to allow us to reasonably verify that you are the person about whom we collected personal information.

Data Security

We employ commercially reasonable physical, technical, and administrative procedures to safeguard the personal information we collect online, including encryption, access controls, and secure data storage. However, no website is 100% secure, and we cannot ensure or warrant the security of any information you transmit to the Site or to us, and you transmit such information at your own risk.

Data Retention

We retain personal information about you necessary to fulfill the purpose for which that information was collected or as required or permitted by law. We do not retain personal information longer than is necessary for us to achieve the purposes for which we collected it. When we destroy your personal information, we do so in a way that prevents that information from being restored or reconstructed.

International Users

The information that we collect through or in connection with the Services is transferred to and processed in the United States for the purposes described above. Linse Capital may subcontract the processing of your data to, or otherwise share your data with, affiliates or third parties in the United States or countries other than your country of residence. The data protection laws in these countries may be different from, and less stringent than, those in your country of residence. By using the Site or by providing any personal or other information to us, you expressly consent to such transfer and processing.

If you are a visitor from the European Economic Area ("EEA"), Switzerland, or the United Kingdom ("UK"), Our legal basis for collecting and using the personal information collected will depend on the personal information concerned and the specific context in which we collect it. In most circumstances, we collect personal information (i) where it is needed for the performance of our Offerings or a contract, (ii) where the processing of the personal information is in our legitimate interests and not overridden by your rights, or (iii) where you provide your consent. Other times, your personal information may be collected in order for us (iv) to comply with a legal obligation, (v) to perform a task for the public interest, or (vi) for the protection of your or another’s vital interests. If we collect and use your personal information in reliance on our legitimate interests or those of any third party, we will make clear to you at the relevant time through this notice or otherwise what those legitimate interests are. Often, legitimate interests involve our normal day-to-day operations, such as the ability to operate our platform and communicating with you as necessary to provide our services, responding to your inquiries, or marketing. We may transfer personal information to companies that help us provide our service. Transfers to subsequent third parties are covered by the agreements with our customers. Linse Capital's mission is global, and therefore, we may store information in the United States and other locations worldwide where we or our service providers have facilities. Where applicable, Linse Capital relies upon an adequate mechanism for the international transfer of personal information. Linse Capital has adopted an appropriate, under Applicable Laws recognized, adequacy mechanism ensuring an adequate level of data protection.

Retention of Personal Information

We will retain your personal information for as long as needed to fulfill the purpose for which we collected it and for a reasonable period thereafter in order to comply with audit, contractual, or legal requirements, or where we have a legitimate interest in doing so. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We may retain aggregated or de-identified data indefinitely or to the extent allowed by applicable law. We may retain personal information preserved in automatically generated computer back up or archival copies generated in the ordinary course of our information technology systems procedures.

European Economic Area, United Kingdom, and Switzerland Residents

If you are a resident of the EEA, UK, or Switzerland and where Linse Capital is a data controller, your data protection rights are as follows:

  • You can request access, correction, or deletion of your personal information.
  • You can do so at any time by submitting a request via our Data Subject Request Form.
  • You can object to processing of your personal information, ask us to restrict processing of your personal data or request portability of your personal information.
  • You can do so at any time by submitting a request via our Data Subject Request Form.
  • You have the right to opt-out of marketing communications we send to you at any time.
  • You can exercise this right by clicking on the “unsubscribe” or “opt-out” link in the marketing e-mails we send you or by visiting our Preference Center.
  • To opt-out of other forms of marketing, such as telemarketing, then please contact Linse Capital using the contact details provided below or by email at finance@linsecapital.com.
  • If Linse Capital has collected and currently processes your personal information with your consent, then you can withdraw your consent at any time.
  • Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.
  • You have the right to complain to a data protection authority about Linse Capital’s collection and use of your personal information.

Linse Capital responds to verifiable requests received from individuals who wish to exercise their data protection rights in accordance with applicable data protection laws. When contacting us, please provide us with detailed information about the personal information you are requesting we correct, update, amend, or remove, and the timeframe and manner in which you believe we came to collect your personal information. If we obtained your personal information from a customer or third party acting on your behalf, you should contact the company or person you provided your information to. If you would no longer like to be contacted by one of our customers or would like to have your personal information corrected, updated, amended, or removed, please contact the customer/data controller that you interact with directly.

California Residents

The California Consumer Protection Act ("CCPA") provides consumers (California residents) with specific rights regarding the processing of their personal information. We may collect this personal information directly from you, from third parties, and from your interactions with our Websites and Web Portals. In regard to personal information provided by you, from third parties, or from your interactions with our Websites, we may retain personal information for as long as is needed for the purpose(s) for which it was collected and no longer than is relevant and reasonably necessary. Our retention periods vary based on business, legal and regulatory needs. In the preceding 12 months and where applicable, we have disclosed each of these categories to our service providers, affiliates, partners, resellers, and event sponsors, in line with the applicable purpose(s) as described above in Section 2.3. In the preceding 12 months, we have disclosed the above categories of personal information to third-party advertising partners, such as in connection with our use of tracking technologies for cross-context behavioral advertising or by providing lists of email addresses for potential customers, so that we can reach you across the web with advertisements for our products and services. This may be considered “sharing” or a “sale” under the CCPA. In the preceding 12 months, Linse Capital has not collected, shared, or sold any sensitive personal information as described in the CCPA.

You have the right to know what personal information we collect, use, disclose, share and sell about you. You have the right to request we correct personal information we collect and maintain about you if such personal information is inaccurate. You have the right to request we delete personal information we collect and maintain about you. You have the right to opt-out of the sale or sharing of your personal data. Linse Capital shares personal data as described above, which may be considered a “sale” of personal data under the CPRA. You have the right to limit the use or disclosure of your sensitive personal data. Linse Capital does not collect, share, or sell sensitive personal data. You have the right not to receive discriminatory treatment from Linse Capital for exercising your privacy rights under the CCPA. You have the right to designate an Authorized Agent to make a request on your behalf when exercising your privacy rights under the CCPA.

How to Contact Linse Capital about Your Rights

Linse Capital responds to verifiable requests received from individuals who wish to exercise their data protection rights in accordance with applicable data protection laws. If you would like to exercise your privacy rights under CCPA or are an Authorized Agent making a request on behalf of a California consumer, please submit a request via our Data Subject Request Form.

After submitting your request, please monitor your email for any follow-up communications from us. The information you provide will be used only to help verify and process your request. If you are an Authorized Agent, we reserve the right to request you demonstrate evidence of your authorization, either by providing us with a signed permission form or a copy of your power-of-attorney granting you such authority.

To opt-out of the sale/share of your personal information, please submit a request via our Opt-Out Form, by emailing your request to finance@linsecapital.com, or by clicking the “Your Privacy Choices” link at the bottom of our website and following the directions provided on that page. Please note that unless you have previously provided your personal information to Linse Capital, your request to opt-out via GPC will be linked to your browser identifier only because Linse Capital does not have any of your personal information to associate your GPC out-out with. If you are an authorized agent making a request on behalf of a California consumer, please email your request to finance@linsecapital.com and provide us the first name, last name, and email address of the California consumer you are making the request for. If you do not provide the requested information, we may not be able to identify the California consumer and process the request. The information you provide will be used only to help verify and process the request. We reserve the right to request you demonstrate evidence of your authorization, either by providing us with a signed permission form or a copy of your power-of-attorney document granting you such authority. If we obtained your personal information from a customer or third party acting on your behalf, you should contact the company or person you provided your information to. If you would no longer like to be contacted by one of our customers or would like to have your personal information corrected, updated, amended, or removed, please contact the customer/business that you interact with directly.

Children

Content on this Site is directed at individuals over the age of 18 and is not directed at children under the age of 13. We do not knowingly collect personally identifiable information from children under the age of 13. If we learn that we have collected personal information from a child under age 13, we will promptly delete that information. If you believe we might have any information from or about a child under age 13, please contact us at finance@linsecapital.com.

Changes to this Policy

We may make changes to the Site in the future and as a consequence will need to revise this Policy to reflect those changes. We will post all such changes on the Site, so you should review this page periodically. If we make a material change to the Policy, you will be provided with appropriate notice.
